Terms and Conditions

Diversified Engage is a communications platform for preparing, protecting, sending, and understanding business email. It is provided by Diversified SaaS, Inc., a wholly owned company of Diversified Universal LLC.

Plans, prices, quotas, discounts, trial terms, and contract lengths are as published or agreed at the time of subscription, and none are created by this document. The subscription, billing, trial, plan change, cancellation, and refund provisions of the Universal Terms and Conditions Framework apply together with the terms published or agreed at that time.

You are responsible for the sending domains you use with Engage, for the DNS access needed to configure them, for the sender identities you verify, for the content of your campaigns, for the quality of your contact information, and for sending lawfully.

Engage can check configuration and report what it observes, including authentication records and the outcomes reported back by the email provider. Those checks describe what was observed at the time and are not a commitment about results. Diversified SaaS, Inc. does not guarantee inbox placement, delivery, acceptance by any receiving provider, or uninterrupted availability of the service.

Once a message has been accepted by the email provider, it cannot be recalled. Controls that pause, resume, or cancel work apply only to messages Engage still holds.

Engage reports what the provider and the recipient's actions tell it. Acceptance by a provider is recorded separately from delivery and is not presented as confirmation of delivery.

You must comply with the rules of the marketplaces, mailbox providers, networks, and services connected with your recipients or your communications, in addition to the law that applies to you.

Diversified SaaS, Inc. may impose mandatory sending limits, content protections, audience classification, confirmation requirements, holds, and other safeguards on the service. These safeguards protect your sending reputation and domains, the sending integrity of the platform, other customers, and compliance with applicable provider and marketplace policies.

Addresses associated with eBay or another protected service may be automatically classified and processed under service-specific protections. Diversified Engage requires a minimum interval of 25 seconds between messages sent to members.ebay.com addresses. That interval is a Diversified Engage safeguard based on its own internal testing and operational protection. It is not a rate published by eBay. A customer may choose a slower interval and may not choose a faster one.

You may not use Diversified Engage to evade marketplace communication rules, to send links or content a marketplace prohibits, to move a transaction away from a marketplace improperly, or to facilitate unlawful or unauthorized communications.

You remain responsible for your recipients, your permissions, your content, your links, the representations you make, and your compliance, whether or not an automatic safeguard applies to a message.

Diversified SaaS, Inc. may refuse, hold, slow, separate, or stop affected messages.

Diversified SaaS, Inc. may restrict, suspend, or terminate access for misuse, for attempted circumvention of a safeguard, for repeated violations, or for conduct that threatens the platform, its sending infrastructure, other customers, or third parties. Suspension or termination for prohibited misuse may occur without refund, to the extent permitted by law and by the applicable agreement.

Diversified SaaS, Inc. does not guarantee that its safeguards will identify every violation, and does not guarantee that they will prevent eBay or another third party from taking action against you.

Service-specific protections may change where documented provider policies, provider requirements, internal testing, or operational evidence justify a change.

Suspected misuse of Diversified Engage may be reported to Diversified SaaS, Inc. at CustomerService@DiversifiedEngage.com.

As between you and us, you retain your rights in the contact information, content, and records you submit, as described in the Universal Terms and Conditions Framework. You represent that you have lawful authority to provide that information and to permit us to process it in order to provide the service.

Your obligations as a sender are set out in the Diversified Engage Acceptable Use Policy and form part of these terms.
